1.  About This Policy

  1. 1.1Hueson Pty Ltd (ABN 52 696 337 667) ("Hueson", "we", "us", "our") is committed to protecting the privacy of individuals who interact with our website and services.
  2. 1.2This Privacy Policy explains what personal information we collect, why we collect it, how we use and store it, who we share it with, and what rights you have in relation to it.
  3. 1.3Hueson Pty Ltd currently has an annual turnover of less than $3 million and is exempt from the requirements of the Privacy Act 1988 (Cth) under the small business exemption. We have nonetheless adopted this policy as a matter of good practice, to build trust with the individuals whose information we handle, and to prepare for future growth beyond the exemption threshold.
  4. 1.4By submitting a contact form on hueson.com.au, you acknowledge that you have read and understood this policy.

2.  Definitions

  1. 2.1"Personal information" means any information or opinion about an identified individual, or an individual who is reasonably identifiable, whether or not the information or opinion is true, and whether or not it is recorded in a material form.
  2. 2.2"We", "us", and "our" refers to Hueson Pty Ltd (ABN 52 696 337 667), a company registered in Queensland, Australia.
  3. 2.3"Website" refers to hueson.com.au and all pages contained within it.
  4. 2.4"Contact form" refers to any form on the Website through which a visitor submits personal information to Hueson.

3.  Information We Collect

  1. 3.1When you submit the enquiry form on the Website, we collect the following categories of personal information: full name, email address, company or organisation name (or, if you are an athlete, your sport and level), phone number, the type of organisation you told us you are, which of our services you told us you are interested in, how you heard about us, and the content of your message.
  2. 3.2We do not collect payment information, government identifiers (including tax file numbers), health information, or any other sensitive information as defined under the Privacy Act 1988 (Cth).
  3. 3.3We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have inadvertently collected such information, we will take steps to delete it promptly.

4.  How We Collect Information

  1. 4.1We collect personal information directly from you when you voluntarily submit a contact form on the Website.
  2. 4.2We may also collect limited technical information automatically when you visit the Website, including your IP address, browser type, pages visited, and time spent on the site. This information is collected via cookies and website analytics tools as described in Section 11 of this policy.
  3. 4.3We do not collect personal information from third party sources.

5.  Purpose of Collection

  1. 5.1We collect personal information submitted via contact forms for the following primary purposes: to respond to your enquiry and provide the information or services you have requested; to assess whether Hueson's services may be suitable for your needs; and to maintain records of business communications.
  2. 5.2We will only use your personal information for secondary purposes (including marketing communications) where you have provided express consent in accordance with Section 9 of this policy.
  3. 5.3We will not use your personal information in a way that you would not reasonably expect.

6.  Storage and Security

  1. 6.1Personal information submitted via the enquiry form is stored in our own database, hosted by Supabase on servers located in Sydney, Australia. A copy is also emailed to us, and email delivery is handled by Resend. Some earlier contact forms additionally recorded submissions in Google Sheets, a service operated by Google LLC, which may store data on servers outside Australia.
  2. 6.2We take reasonable steps to protect the personal information we hold from misuse, interference, loss, and from unauthorised access, modification, or disclosure.
  3. 6.3Access to stored personal information is restricted to authorised personnel of Hueson Pty Ltd only.
  4. 6.4We will retain personal information for as long as it is reasonably necessary for the purposes for which it was collected, or as required by law. When information is no longer required, we will take reasonable steps to destroy or de-identify it.

7.  Third Party Processors

  1. 7.1We use the following third party service providers to process personal information on our behalf: Supabase, for hosting the database in which enquiries are stored; Resend, for delivery of the emails that notify us of an enquiry; Vercel, which hosts this Website and processes the request that carries your submission; and Google LLC (Google Sheets), which records submissions from some earlier contact forms.
  2. 7.2These providers act as data processors on our behalf. They are contractually required to handle personal information only as directed by us and in accordance with applicable privacy laws.
  3. 7.3Our database is hosted in Sydney. Data processed by Resend, Vercel and Google may be transferred to and stored on servers located outside Australia. By submitting the enquiry form, you consent to this transfer.
  4. 7.4We will not engage additional third party processors without updating this policy to reflect such changes.

8.  Disclosure to Third Parties

  1. 8.1We do not sell, trade, rent, or otherwise transfer your personal information to third parties for their own purposes.
  2. 8.2We will not disclose your personal information to any third party except: to our third party processors as described in Section 7; where required or authorised by law, including in response to a lawful request from a government authority or court; or where you have given express consent to the disclosure.
  3. 8.3If Hueson is involved in a merger, acquisition, or sale of assets, personal information may be transferred as part of that transaction. We will notify affected individuals in such circumstances.

9.  Marketing and the Spam Act 2003

  1. 9.1We will not send you marketing or promotional communications unless you have provided express consent to receive them.
  2. 9.2The enquiry form does not carry a marketing opt-in checkbox, and submitting an enquiry does not constitute consent to receive marketing communications. We use the details you provide to answer you. If we later add a way to opt in to marketing, it will be a clearly labelled choice you have to make yourself, and this policy will be updated before it appears.
  3. 9.3All marketing communications sent by Hueson will comply with the Spam Act 2003 (Cth), including by identifying Hueson as the sender, including a clear and functional unsubscribe mechanism in every message, and honouring unsubscribe requests promptly and within five business days.
  4. 9.4Every email sent by Hueson will include our registered business address and a working unsubscribe link, as required under the Spam Act 2003 (Cth).

10.  Automated Tools and Artificial Intelligence

  1. 10.1Hueson may use automated tools and artificial intelligence systems to assist with organising, categorising, and analysing business enquiries. This may include the use of AI-assisted software to help route enquiries to the appropriate team member or to identify patterns in inbound communications.
  2. 10.2No automated or AI-driven process will be used to make decisions that produce significant legal or similarly significant effects on any individual without human review.
  3. 10.3The use of automated tools does not alter the purposes for which your information is collected as described in Section 5 of this policy.

11.  Cookies and Website Tracking

  1. 11.1The Website uses cookies and similar tracking technologies to improve user experience and analyse website traffic. Cookies are small data files stored on your device when you visit the Website.
  2. 11.2We may use the following types of cookies: essential cookies, which are necessary for the Website to function correctly; and analytics cookies, which help us understand how visitors interact with the Website. We may use tools such as Vercel Analytics or Microsoft Clarity for this purpose.
  3. 11.3You may disable cookies through your browser settings. Please note that disabling cookies may affect the functionality of the Website.
  4. 11.4Australia does not currently require a cookie consent banner for websites that only use analytics and functional cookies. We nonetheless disclose our cookie use in this policy in the interests of transparency.

12.  Your Rights

  1. 12.1You have the right to request access to the personal information Hueson holds about you. We will respond to access requests within 30 days.
  2. 12.2You have the right to request that we correct any personal information we hold about you that is inaccurate, incomplete, or out of date.
  3. 12.3You have the right to request that we delete your personal information. We will comply with such requests unless we are required by law to retain the information.
  4. 12.4You have the right to withdraw any consent you have previously provided for the use of your personal information for marketing purposes. Withdrawing consent does not affect the lawfulness of any processing carried out before the withdrawal.
  5. 12.5To exercise any of these rights, please contact us using the details in Section 16 of this policy.

13.  Data Breach Response

  1. 13.1Hueson maintains an internal Data Breach Response Plan. In the event of a suspected or confirmed data breach, we will take the following steps: identify and contain the breach as quickly as possible; assess whether the breach is likely to result in serious harm to any affected individuals; notify affected individuals as soon as practicable if there is a real risk of serious harm; and notify the Office of the Australian Information Commissioner if required.
  2. 13.2Although Hueson is currently exempt from the mandatory Notifiable Data Breaches scheme under the Privacy Act 1988 (Cth), we are committed to handling any breach transparently and responsibly.

14.  Complaints

  1. 14.1If you have a complaint about the way Hueson has handled your personal information, please contact us in the first instance using the details in Section 16 of this policy.
  2. 14.2We will acknowledge your complaint within five business days and aim to resolve it within 30 days. If we require additional time, we will notify you.
  3. 14.3If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or by calling 1300 363 992.

15.  Changes to This Policy

  1. 15.1We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal obligations.
  2. 15.2The current version of this policy will always be available at hueson.com.au/privacy. The date at the top of this document reflects when the policy was last updated.
  3. 15.3Continued use of the Website after any changes to this policy constitutes acceptance of the updated policy.
